William Fielding Owston LCC Wills 1848/145 written 28 Dec 1837, proved 12 Jun 1848
The Testator died 20 Dec 1847, two codicils written 27 Jan 1844.

This is the last Will and Testament of me William Fielding of West Kinnald Ferry in the parish of Owston in the County of Lincoln yeoman.

I give and devise all that my Messuage or Dwellinghouse with the yard gardens outbuildings homestead and appurtenances situate in West Kinnald Ferry aforesaid as lately occupied by William Broadhead and also the garden or small parcel of Land adjoining the River Trent now occupied by myself and also all these my several Closes or parcels of Land lying together in the parish of Owston aforesaid called the Becks Closes containing together by estimation six acres more or less unto and to the use of my Daughter Sarah Harrison her Heirs and assigns forever but subject nevertheless to and charged with the payment thereout in exoneration of the other Estates charged therewith of one equal half part of the annuity or annual sum often pounds now payable by me to Ann Needham during her life and to the powers and remedies for securing the same and

I give and devise all that my Messuage or Dwellinghouse with the shop yard garden outbuildings homestead and appurtenances thereto belonging situate and being in West Kinnald Ferry aforesaid. Also all that my Close or parcel of new enclosed Land situate within the parish of Owston containing by estimation five acres called Thornholmes. Also all that Selious Parcel of land lying in Ferry Crofts within the parish of Owston aforesaid near Mr. Stainton’s Wood Yard containing by estimation about half an acre and half a rood ( ) all which said Messuage Lands and premises are now in the occupation of Gervas Wadson with their respective appurtenances unto and to the use of my Daughter Mary Wadson her Heirs and assigns for ever but subject nevertheless to and charged with the payment thereout in exoneration of the other Estates charged therewith of the other equal half part of the said annuity or annual sum often pounds now payable by me to the said Ann Needham during her life and to the powers and remedies for securing the same and

I give and devise all that my Messuage or Dwellinghouse situate and being in the West Kinnald Ferry aforesaid with the yard garden orchard old Barn Stables outbuildings Homestead and appurtenances thereunto belonging except the new Barn one half part of the Waggon House and the road to the same with the appurtenances as now occupied by my Son William and hereinafter devised to him as now occupied by my Son Moses. Also all those three selious or parcels of Land lying together at the bottom of the said Homestead called Ferry Crofts and containing together by estimation one acre and a half more or less. Also all that one equal half part of all that other selious or parcel of Land containing by estimation two roods lying in Ferry Croft aforesaid at a place called the Far Wood Yard. Also all those several Closes or parcels of Land situate within the parish of Owston aforesaid called the Warp Closes adjoining each other and containing by estimation ten acres (more or less) Also all that Close or parcel of enclosed Land situate within the parish of Owston aforesaid called Woodends Close containing by estimation four acres and a half (more or less) Also all that Close or parcel of enclosed Land situate within the parish of Owston aforesaid called Kirton Close containing by estimation three acres and a half (more or less) And also all that other Close or parcel of enclosed Land situate within the parish of Owston aforesaid called new Dykes containing by estimation four acres (more or less) all which said last mentioned Messuage Closes Lands and premises are in the occupation of my Son Moses Fielding together with the respective roads and appurtenances to the same belonging unto and to the use of him my said Son Moses Fielding his Heirs and assigns forever But subject nevertheless to and chargeable with the payment thereout of one equal part of all principal Monies and Interest due and owing by me on Mortgage of all or any part of my real Estates and also of one equal half part of the Legacies or Sums of forty pounds apiece hereinafter bequeathed to the five children of my late Son Aaron and of one moiety of the expenses of educating and bringing up of such children until they attain their respective ages of twenty one years and

I give and devise all that my Messuage or Dwellinghouse with the yard garden orchard new Barn Stables one half part of my Waggon house with the road to the same Homestead and appurtenances as now occupied by my Son William Also all those two selious or parcels of Land in Feriy Crofts within the parish of Owston aforesaid at a place called Low Furlong containing by estimation half an acre and half a rood (more or less) Also all those three selious or parcels of Land in Ferry Crofts within the parish of Owston aforesaid at a place called the Top Furlong one of them called Pelsworths Road and containing by estimation one rood (more or less) and the other two containing by estimation two roods (more or less) also all that other equal half part of the said selious of Land in Ferr

I give and bequeath unto each of the five children of my late son Aaron the Legacy or Sum of forty pounds Sterling and direct the same to be paid to them by my said Sons Moses and William in equal shares out of the Hereditaments hereinbefore respectively devised to them on such children attaining their respective ages of twenty one years But in the event of any one or more of the said five Children dying under the age or twenty one years without having any lawful Issue him her or them surviving or born in due time afterwards then and in such case I will and direct that the Legacy or Legacies of him her or them so dying shall be paid unto the survivors or survivor of them and the Issue of any child that may be dead leaving Issue in equal shares and proportions nevertheless the Issue of any deceased child being only entitled among them to the same share as their parent would have been entitled to if living and I give unto the said five children of my said late son Aaron Fielding a suitable maintenance education and bringing up during their respective minorities and I charge the same upon the respective Hereditaments hereinbefore devised to my said Sons Moses and William and I appoint my Friends Thomas Standring of Owston aforesaid Butcher and Stephen Jenkin of West Kinnald Ferry aforesaid Bricklayer Guardians of my said Grandchildren during their respective minorities and I especially request them to superintend the maintenance education and bringing up of my said Grandchildren and to take and use every necessary means for securing the same in a suitable and proper manner And I give and bequeath all my personal Estate and Effects except my household furniture which I give to my son William absolutely unto my said Sons Moses and William in equal shares subject to the payment of my just Debts and funeral and testamentaiy expenses and I appoint my said Sons Joint Executors of this my Will and hereby revoking all my former Wills I do declare this to be my last Will and Testament. in Witness whereof I the said William Fielding the testator, have to this my last will and testament contained in this and the four preceding sheets of paper set my hand and seal (to wit) my hand to and at the bottom of each of the said four Sheets and my hand and seal to this last sheet and my seal at the top of the said sheets where all the said sheets are fixed together, this Twenty eighth day of December one thousand eight hundred and thirty seven

The writing contained in this and the four preceding sheets of paper was signed and sealed by the above named William Fielding and by him published and declared as and for his last will and Testament in the presence of us who have hereunto subscribed our names in his presence and in the presence of each other.

A Codicil to be amended to and taken as part of the last Will and Testament of me William Fielding of West Kinnald Ferry in the parish of Owston in the County of Lincoln yeoman and which Will bears date the twenty eighth day of December one thousand eight hundred and thirty seven. Whereas I have by my said Will given and devised amongst other Hereditaments All that my Close or parcel of new inclosed Land situate within the parish of Owston and containing five acres called Thornholmes Unto and to the use of my daughter Mary Wadson her heirs and assigns for ever But subject as therein mentioned Now I do hereby revoke and make void the said gift and devise of the said Close or parcel of Land called Thornholrnes to my said daughter Mary Wadson and I do hereby give and devise the same Close with the appurtenances Unto my son Moses Fielding and my friend Robert Sharp of West Kinnald Ferry aforesaid Schoolmaster their heirs and assigns Upon trust that they or the survivor of them and the heirs or assigns of such survivor do and shall let or devise the same from year to year or for a term not exceeding twenty one years in possession as they or he shall think proper at the best and most improved rent that can be obtained for ihe same and do and shall from time to time pay and apply the rents proceeds and profits, thereof as the same shall become due and be received unto and ft)r the use and benefit of my grandson William Fielding a son of my said son Moses Fielding for and during the term of his natural life and from and immediately after his decease. Then upon further Trust that they my said Trustees and the survivor of them and his heirs and assigns do and shall stand seized and possessed of the said Close of Land called Thornholmes in trust for the use and benefit of all and every the lawful child and children of him my said Grandson William Fielding living to attain the age of twenty one years their respective heirs and assigns for ever in equal shares and proportions But in case there shall he no issue of my said Grandson William living to attain the age of twenty one years then and in such case upon further trust that they the said Moses Fielding and Robert Sharp and the survivor of them and the heirs and assi~ins of such survivor do and shall stand seized and possessed of the said Close called Thornholmcs unto and for the absolute benefit of my grandson John Fielding another son of my said son Moses Fielding his heirs and assigns for ever and whereas I have in and by my said will given and bequeathed unto each of the five children of my late Son Aaron the Legacy or sum of Forty pounds Sterling to be paid to them by my Sons Moses and William as in the said Will is parlicularly mentioned. Now I do hereby revoke and make void the said gift and bequest of the said several Legacies or sums of Ibm’ pounds apiece so given to the five children of my said late son Aaron and I hereby give and bequeath unto my Granddaughter Syndonia the youngest daughter of him my said late son Aaron the Legacy or Sum of nineteen pounds nineteen shillings Sterling and direct the same to be paid to her by my said Sons Moses and William in equal shares out of the hereditaments respectively devised to them by m said Will on her attaining the age of twenty one years But in case of the death of my said Granddaughter Syndonia under the age of twenty one years and without leaving lawful issue her surviving Then I do direct that the said legacy or Sum of Nineteen pounds Nineteen Shillings hereby bequeathed to her shall lapse and become void for the benefit of my said sons Moses and William. And Whereas I have in and by my said Will appointed my friend Thomas Standring of Owston aforesaid Butcher along with my friend Stephen Jenkinson in my said will called Stephen Jenkins of West Kinnald Ferry aforesaid Bricklayer Guardians of my said Grandchildren Now I do hereby revoke such appointment so far as related to the said Thomas Standring being one of such guardians and in his place and stead I hereby appoint my friend the said Robert Sharp (jointly with the said Stephen Jenkinson) Guardian of my said grandchildren during their respective Minorities and I do hereby ratify and confirm my said Will in every respect except where the same is hereby revoked and altered as aforesaid In Witness whereof I the said William Fielding the Testator have to this codicil contained in three sheets of paper set my hand to the two first sheets thereof and my hand and seal to the third and last sheet thereof the twenty seventh day of January one thousand eight hundred and t’ort four.

This is a second Codicil to the last Will and Testament of me William Fielding of West Kinnald Ferry whereas I have by my said Will devised certain hereditaments therein mentioned to my Daughter Sarah Harrison in fee subject to the payment thereout of one equal half part of the annuity or annual sum of Ten pounds payable by me to Ann Bainton late Needham during her life and to the powers and remedies for securing the same and I have also by my said Will devised certain other hereditaments therein mentioned for my daughter Ann Watson in fee subject to the payment thereout of the other equal half part of the said annuity or annual sum of Ten pounds to the said Ann Bainton and the powers and remedies for securing the same, Now I do hereby revoke and make void the said charge of the said annuity or annual sum of ten pounds to the said Ann Bainton upon the said several hereditaments so respectively devised to the said Sarah Harrison and Ann Watson as aforesaid and instead thereof I do hereby change the same annuity or annual sum and the powers and remedies for securing the same.

On the twelfth day of June in the year of our Lord one thousand eight hundred and forty eight Moses Fielding and William Fielding the executors within named were duly sworn and also made oath that the whole of the personal estate and effects of the deceased at the time of his death did not amount in value to the sum of one hundred pounds

The Testator died on the twentieth day of December 1847
