This is the last Will and Testament of me Robert Wilkinson of East Ferry in the parish of Scotton in the County of Lincoln Gentleman made this twenty third day of April in the year of our Lord One thousand Eight hundred and twelve in manner following that is to day First I will and direct that all my just Debts Legacies and Funeral Expenses and the Expenses of proving this my Will be fully paid and satisfied by my Executors hereinafter named And I do give and bequeath unto my Aunt Elizabeth Akerill the wife of Joseph Akerill of West Woodside in the parish of Haxey in the said County of Lincoln Miller and her Assigns for and during the Term of her natural Life One Annuity or clear yearly Sum of Ten pounds, to be issuing payable and paid by from and out of and charged and chargeable upon my real Estates by equal half yearly payments the first payment to be made to her at the end of Six Months next after my decease and I do direct the same to be paid unto her own Hands for her own separate use incontrolable of her present or any future Husband and her Receipt alone not withstanding her Coverture shall from time to time be a good discharge for the same Also I give and bequeath unto Ann Needham of East Ferry aforesaid Spinster and her Assigns for and during the term of her natural Life One Annuity or clear yearly Sum of Ten pounds to be also issuing payable and paid by from and out of and charged and chargeable upon my real Estates by equal half yearly payments the first payment to be made to her at the end of the Six Months next after my decease And I do hereby give unto the said Elizabeth the Wife of Joseph Akerill and unto the said Ann Needham and to each of them and their and each of their Assigns such powers and remedies for recovering and enforcing the payment of the said two Severall Annuities by distress and entry upon and perception of the Rents and profits of the said Real Estates charged therewith as are usually given and granted for securing Rent Charges Also I do give and bequeath unto my Servant James Wressell as a Testimony of my regard for his long and faithful services the Sum of Two hundred pounds to be paid to him at the End of twelve Months next after my decease And I do hereby subject charge and make liable all my real Estates to and with the payment thereof And I give and bequeath unto John Furley of Gainsburgh in the said County of Lincoln Surgeon All my Library of Books, Except Gregory’s Dictionary of Arts and Sciences which I do give unto Charles Briggs of West Ferry in the parish of Owston in the said county of Lincoln Bricklayer Also I give and bequeath unto Cornelius Sandars of West Ferry aforesaid Esquire and to my Brother in Law William Fielding of West Ferry aforesaid Farmer the Sum of Two hundred pounds to be paid to or retained by them immediately after my decease upon Trust that they the said Cornelius Sandars and William Fielding or the Survivor of them his Executors or Administrators do and shall place and continue the same Sum out of Interest on good and sufficient security at their discretion and pay the yearly Interest and produce thereof as the same shall arise or be received unto the Overseer or Overseers of the poor of the Township of East Ferry aforesaid, to be by them distributed and divided in equal shares unto and amongst the poor Widows residing in or belonging to the said Township at Midsummer and Christmas in every year for ever the first payment and distribution to begin and be made at such of the said times as shall first happen after my decease Also I give and bequeath unto them the said Cornelius Sandars and William Fielding the further Sum of Two hundred pounds to be paid to or retained by them immediately after my decease upon Trust that they the said Cornelius Sandars and William Fielding or the Survivor of them his Executors or Administrators do and shall place or continue the same out at Interest on good and sufficient security at their discretion and pay the yearly Interest and produce thereof as the same shall arise and be received unto the Trustees or Governors hereinafter to be appointed of a certain Charity School which is now in contemplation or intended to be immediately erected and established at East Ferry aforesaid and to be by them laid out and disposed of in or about the erecting and establishing such School and for the purpose of teaching and educating the Children of such poor persons as reside in the Township of East Ferry aforesaid and who are not of ability to pay for their Education Provided always and it is my Will and Mind and I do hereby declare that in Case such Charity School shall not be promoted and established by the parishoners or Inhabitants of the Township of East Ferry aforesaid for the space of Six Months after my decease, or from the time of their being made acquainted with this bequest, which I direct shall be done at a vestry meeting to be called for the purpose on the Sunday next after my Interment Then and in such Case I will and direct that the said Legacy or Sum of Two hundred Pounds shall ....k into the residue of my personal Estate by me hereinafter given and bequeathed Also I give devise and bequeath unto my said Brother in Law William Fielding his
Heirs Executors Administrators and Assigns All my Freehold Messuages Cottages Lands Tenements Hereditaments and Real Estate situate standing lying and being at West Ferry and in the parish of Owston in the said County of Lincoln or elsewhere in the Kingdom of Great Britain with their and every of their Appurtenances, and all Monies owing to me on Mortgages Bonds and other Securities, and all and every the real or Freehold and other Estate and/Estates whatsoever in anywise charged or affected with the payment thereof and also all the rest residue and remainder of other my personal Estate and Effects of what nature and kind soever Tohold unto the said William Fielding his Heirs Executors Administrators and Assigns for ever, Also I give and bequeath unto the said Cornelius Sandars the Sum of Ten pounds as a Tribute of respect and a small acknowledgment for the trouble he may have in the Execution of the Trusts hereby imposed upon him And I do will and direct that they the said Cornelius Sandars and William Fielding and the Survivor of them his Heirs Executors and Administrators shall and may from time to time deduct and retain out of the said Trust Monies and Premises all such Cost Charges and Expences as they or either of them shall bear pay sustain or be put unto in or about the Execution of the Trust hereby reposed in them And that they my said Trustees or the Survivor of them his Heirs Executors or Administrators shall not be chargeable with or accountable for anymore of the said Trust Money than they shall respectively actually receive or shall come to their or either of their Hands by virtue of this my Will wither shall they or either of them be answerable for any Loss or Losses of the said Trust Premises or any part thereof by reason of the defect or Failure of any Security or Securities or of any Bank or Bankers where any of the said Trust Money may be placed till Security can be got for the same or otherwise unless the same shall happen through their or one of their wilful neglect or default neither shall they or either of them be answerable one for another or for the acts deeds receipts or defaults of the other of them but each of them for his own Acts Deeds Receipts or Defaults of the other of them but each of them for his own Acts Deeds Receipts and defaults only And Lastly I do hereby make Ordain constitute and appoint the said Cornelius Sandars and William Fielding joint Executors of this my last Will and Testament hereby revoking all former and other Will and Wills by me at any time heretofore made In Witness whereof I the said Robert Wilkinson the Testator have to this my last Will and Testament contained in four Sheets of paper set my Hand and Seal, that is to say, my Hand at the bottom of the first three Sheets thereof and my Hand and Seal to this the fourth or last Sheet the day and year first about written

This is a Codicil to be added to the last Will and Testament of me Robert Wilkinson of East Ferry in the parish of Scotton in the county of Lincoln gentleman First I do ................................. the good will of All that Farm Messuage or Tenement wherein I now dwell situate and being at Ferry aforesaid in the parish of Scotton and all and every the Yards Gardens Outbuildings and other appurtenances thereto belonging and therewith used and enjoyed And also all the Crops of Corn now standing on the said Farm of what nature or kind soever, which said Farm and Premises I now hold or Rent of Sir John Frederick my Landlord the said James Wressell paying the rent now due and owing to the said landlord And my Will and Mind is that he the said James Wressell shall and may have the Possession of the said Premises and Crops of Corn immediately after my Decease And I do hereby ratify and confirm my said will in all other respects In Witness whereof I have hereunto set my Hand and Seal the Eighteenth day of June One thousand eight hundred and Twelve

Will Robt Wilkinson East Ferry in the parish of Scotton 1814 sub L2000

On the 13th day of June 1814
William Fielding one of the Executors named in the within written will was re-sworn to and made oath that to the best of his knowledge and belief the whole of the personal property of the within named testator Robert Wilkinson did not amount to two thousand pounds, Cornelius Sandars the other executor having by proxy under his hand & seal renounced and refused to take upon himself the ... of the execution of the will of the said deceased

Know all Men by these Presents that I Cornelius Sandars of West Ferry in the parish of Owston in the County of Lincoln Esquire one of the Executors named in the last Will and Testament of Robert Wilkinson late of East Ferry in the parish of Scotton in the said County Gentleman deceased not having any ways intermeddled in the Goods Chattels and Credits of the said deceased for divers good causes and considerations me & hereunto especially moving do absolutely renounce and refuse to take upon myself the execution of the Will of the said Robert Wilkinson deceased And, that, this my Renunciation may have its due effect in Law I do by these presents nominate constitute and appoint John Fardell Notary Public one of the Procurators General of the Consistory Court of Lincoln to be my true and lawful proctor for me and in my name to appear before any competent Judge in this behalf and pray and procure this my Renunciation to be admitted and enacted and generally to do whatever is or shall be necessary in and concerning the premises and whatever my said proctor shall lawfully do herein I promise to ratify and confirm In witness whereof I have hereunto set my hand and seal the second day of May in the year of our Lord one thousand eight hundred and fourteen

Dear Sir
Re. Wilkinson - Annexed you have Mr Sandars Renunciation, but our client, Fielding, says positively he will not prove the codicils, as in his conscience he cannot swear that he believes them to be the will of the said Testator. I shall therefore retain the original Will until I ... from you again upon the subject stating what is to be done.
